Ironis Diskusi Hentikan Polimik Hudud, Menambah Polimik!

Salam semua , tidak ramai yg tahu bahawa laporan Sinar Harian 23 Ogos, muka depan tentang kenyataan saya bukanlah wawancara dgn saya secara terus tetapi telah di petik secara ‘berpilih’ atau ‘selective oleh SH dari rakaman program Let’s Talk! Hentikan Polimik Hudud dgn Ust Fathul Bari. Saya sedar betapa laporan itu telah mencetus kan pelbagai reaksi dan kecaman khususnya dari ahli dan pimpinan PAS. tetapi saya mendapat sokongan yang padu dari sgemen golongan anak muda termasuk mendapat satu dari Imam Muda ASyraf, tak perlulah saya quote tweetnya macam ‘angkat bakul’ sendiri pula nanti.

Saudara boleh baca dan fahami maksud saya sbenar mengapa agenda Hudud mesti menjadi agenda “Bi-Partisan” dan diangkat oleh seluruh Ummat bahkan termasuk sokongan dari penganut agama lain dan etnik Cina dan India, KDM dll. Kalau sdra telah menonton MobTV.com itu 78 minit itu, sdra dapat mengelakkan dari menuduh saya macam-macam termasuk PARASIT dsbnya..macam tududhan kawan lama saya tu pulak..Tak apa lah kali ini saya maafkan. Usaha PAS sejak berdekad lamanya dgn terugubal Enakmen Kesalahan Syariah di Terengganu dan Kelantan pun telah saya sebutkan dan JANGAN siapa  mencabar Komitmen dan Iltizam PAS dalam Hal ini. Jadi terawat sikit perasaan Tok Guru Nik Aziz.

Namun semua telah berlaku dan ia MENDIDIK kita dan sebagai TAJRIBAH utk saya dan sdra. Ayuh kita FOKAS Isus-isu SEBENAR PRU ke-13 ! Apa dia-? Pertembungan Dua Gerombolan – secara sihat dan matang harapnya – AYOH! Mengangkat Agenda Perubahan demi ISLAH -Penambahbaikan dan KEMAKMURAN Rakyat dan Negara. (Was Ta’Marakum Fiha).

SHAH ALAM – Ahli Parlimen Kuala Selangor, Dr Dzulkefly Ahmad meminta semua pihak bersama-sama mengangkat pelaksanaan hukum hudud sebagai agenda umat dan bukannya parti politik semata-mata.

Beliau tidak mahu polemik hudud diketengahkan, sebaliknya mahu semua pihak, termasuk Pas, Umno, pertubuhan bukan kerajaan (NGO) dan para akademik bersama-sama dalam perkara itu.Dr Dzulkefly Ahmad

Dzulkefly berkata, Pas terbukti sentiasa komited memperjuangkan syariah secara menyeluruh.

Beliau berkata, Pas berjiwa besar dan ingin mengajak semua pihak untuk bersama-sama kerana ia bukanlah tugas parti itu sahaja untuk menjadikan pelaksanaan hukum hudud tercapai.

Katanya, semua pihak perlu bersama-sama meminda Akta Mahkamah Syariah 1965 kerana selagi ia tidak dipinda maka hudud tidak dapat dilaksanakan.

“Akta Mahkamah Syariah 1965 perlu dipinda kerana ia menjadi penghalang kepada pelaksanaan hukum hudud,” katanya ketika dihubungi Sinar Harian, di sini semalam.

Kelmarin, akhbar ini melaporkan Dzulkefly menjelaskan hudud tidak boleh dilaksanakan selagi rakyat tidak menerima dan memahami undang-undang Islam itu secara menyeluruh.

Bagaimanapun, Dzulkefly berkata, perkara itu tidak perlu dibuat dalam keadaan terburu-buru kerana ia memerlukan penerangan, didikan dan penjelasan yang secukupnya.

Menurutnya, penerangan yang menyeluruh adalah amat penting supaya rakyat memahaminya.

Katanya, walaupun hukum hudud tersebut adalah untuk orang Islam, tetapi orang bukan Islam juga dibenarkan untuk memberi sebarang pandangan.

“Ia mesti bina pendekatan mendidik dan menerangkan kepada semua pihak termasuk bukan Islam agar mereka faham mengenainya.

“Perkara ini tidak perlu tergesa-gesa dan kita mesti cermat dalam menerangkan kepada rakyat supaya sekurang-kurangnya sebahagian daripada mereka memahami mengenainya dan barulah ia demokratik,” katanya.

Dzulkefly berharap isu hudud ini tidak terus dipolemikkan dan dapat memberi laluan kepada Pilihan Raya Umum (PRU) terlebih dahulu.

Katanya, semua pihak perlu fokus kepada isu sebenar PRU.

“Izinkan PRU berlalu dahulu dan kita fokus isu sebenar PRU iaitu melibatkan ekonomi, harga barang naik, rasuah dan sebagainya,” katanya.

    Dr Zul..saya setuju dengan anta sebenarnya…kita cerita sana sini bab hudud..malah dah 20 tahun lulsu enakmen..tapi bagaimana usahanya?zero..dengan hanya mengambil langkah menyalahkan gomen persekutuan<takut dengan sehelai surat..saya kira malang sekali pimpinan yg ada mentaliti camni…sepatutnya,kita bina dulu apa yang ada,upgrade sistem kehakiman syariah sedia ada,biar nampak hebat dulu,sistem pendakwaan biar nampak cerdik dan wibawa,hisbah biar nampak gah dan berilmu,ini tidak..dek kearna halangan perseketuan,maka dibiarkan semua tu,sistem yg ada di kelantan sekarang amat kebelakang..u2 takzir pun dah lapok,hakim syarie terabai,mahkamah pun persekutuan bagi bajet,penmdakwaan yg hanya tahu kes khlawat,hisbah pun sangap bab undang dan prosedur…apalah nak didabikna konon nak lkasankana hudud?dah bersedia laksana hudud?bersedia celah mana?andai kata persekutuan bagi laksana,saya kira terkincit kelantan nak laksanakanya..oleh itu..Dr buatlah kajian pada enakmen,realiti yg ada dalam mahkamah syariah sedia ada sekarang dan pendakwaanya,adakah benar..kita serius nak laksanakan hudud atau momokan politik semata.WA

    Setuju dr Dzul. Hudud itu tidak harus dipolitikkan. Hudud itu adalah tanggungjawab seorang hamba kepada tuhannya.

    Hujahan Dr. Dzulkefly adalah bernas, jelas, adil dan mantap. Hujahan begini boleh diterima oleh rakyat berbilang kaum.

    me as non muslim what kind of hudud perception is cruelty of execution such as amputation for theft, stone to death for zina, and beheading for killing. Its hard to be accept by most non muslim. I m not against Islam but just to express feeling what non muslim think. I have no issue of death penalty for serious crime like murder, but pls be humane. What the feeling of the family member of the person with discomposed body and head. If a person is amputated for stealing, who is gonna to support him in coming days? Use public money again?

      Bryan jangan kamu fikir orang yg mencuri sahaja yang kena curi (mangsa)pulak macam mana? kita dengar dan tahu ramai mangsa kecurian dibunuh dan dicederakan oleh pencuri,mengapa kita tidak adil fikirkan kepada mangsa pula. Satu lagi hukuman2 ini sebagai satu pencegahan daripada mencuri,kenapa tidak percaya? Kamu sendiri pun takut dan risau kan bagaimana nasib si pencuri. Kamu bandingkan kes kecurian di Arab saudi dengan negara Malaysia,jauh bezanya. Hukuman ini utk menggentarkan hati si pencuri dari mencuri. Kalau kita bukan pencuri janganlah risau yg takut hanyalah pencuri sahaja. Kalau kamu sudah jadi mangsa pencuri dan peragut saya percaya kamu akan buat lebih dari potong tangan ini pengalaman kenalan saya yang kena ragut sehingga cedera parah.

    In short, for your questions on the person that steals..Imagine this..a group of robbers broke into a house, tie up all the people inside it, ransacked the house, traumatise the people, etc etc…After that, the people in the house no longer feel safe to live there (the neighbours too), have sleepless nite, etc etc..

    I’m not sure if the hand of the robbers shall not be amputated to safeguard the others..

    dear bryan,

    The core of Islamic jurisprudence (syariah) is of course, the same as other written laws, ie to enact the concept of Rule of Law among society.

    The only difference is we Muslims believe that Islamic law is divine in nature, and therefore is unquestionable.

    Anyone knows that any law is ineffective without accompanying deterrent punishments. Hudud is simply a set of corporeal punishments that seeks to deter people from committing crimes that, if unchecked could plunge humanity into total chaos and social disarray.

    It must be made clear that syariah is not about moral policing, it is about justice and is designed to protect people and not to harm them. Any law abiding citizen should not be afraid of hudud, in fact they should be relieved knowing that it covers them in a blanket of protection from becoming victims of crime.

    I see that you show sympathy towards the perpetrators of crime, especially lesser crimes such as theft and zina. You should understand that any law – worldly or heavenly – is not about sympathy or hatred, it is about justice and maintaining order in society.

    Anyone knows that a thief could easily become a sadistic murderer when cornered to a limit. A purse snatcher could potentially kill his victim. A boy who is today a petty thief could one day graduate into an armed robber who will not hesitate to slash his victims or shoot them point blank. A group naughty boys who at first steal from shops could very well end up being gangsters and ah longs and instill fear among law abiding citizens.

    A classic example is the world’s most notorious crime lord Pablo Escobar. A Colombian who started his crime career stealing gravestones. He soon became a feared drug lord and was responsible for the death of thousands of lives.

    Regarding zina, the stoning death is penalty meted out to adulterers – married people who commit illicit sex. You should know that in traditional or modern societies, extramarital affairs could very well lead to gruesome violence or worse, murder. Mind you, crimes of passion are not isolated incidences in our society, you get to read about them from time to time in newspapers. A few years back, a young Malay artist was killed in such a crime.

    You talk about “..the feeling of the family member of the person with discomposed body and head”. You should talk to a forensic examiner what the bodies of victims of brutal homicide look like. Women, the elderly, children, babies. Signs of barbaric torture, mutilations and such. You couldn’t help but imagine the sufferings and the pain that they had to endure. Now please imagine the poor families of those victims as they look at the terrifying conditions of their beloved. All the criminal get is a quick blow of a sword in the neck. A quick death.

    You asked “If a person is amputated for stealing, who is gonna to support him in coming days?” In my opinion, a criminal who steals even under the threat of amputation is either a hardcore criminal or a habitual one, and hardcore criminals tend be very aggressive and violent in nature. They could potentially become murderers. Now we have a bonus, most criminals are also habitual drug users, and they tend to be very violent, especially those who do amphetamine type stimulants.

    So my questions are, if a father is killed during a theft attempt, who will support his family? If a mother dies, who will care for her young ones?

    You need not worry. Like any other law, Islamic law operates on strict burden of proof protocol. In the case of amputation for example, there are many strict requirements to be followed before an accused could be punished. Admission of guilt, two reliable male witnesses, the value of the stolen goods, the general situations of the state (eg war, famine), the background status of the criminal (eg pauper, beggar).

    The more grave a punishment, the more strict the burden of proof is and the more strict the requirements to be followed.

    In Islamic law, the power to pardon does not lie on the state, but on the victims or the families of the victims. If the family of the murder victim pardon the murderer, that will literally save his neck.
